Terms & Conditions

Please read these Terms & Conditions carefully before using our website or placing an order with Moggans.

These terms apply to consumer purchases made through the Moggans website. By placing an order with us, you agree to these terms.

Our Delivery Policy, Refund Policy and Privacy Policy also apply and should be read alongside these terms.

References in these terms to “Moggans”, “we”, “us” or “our” mean Live On The Edge Ltd trading as Moggans.

References to “you” or “your” mean the person using our website or purchasing products from us.

2. Who can place an order by placing an order through our website, you confirm that:

  • you are legally capable of entering into a binding contract;
  • you are at least 18 years old, or have the permission of a parent or legal guardian;
  • the information you provide is complete and accurate; and
  • you are purchasing the products primarily for personal use and not for unauthorised resale.

Wholesale and trade purchases may be subject to separate terms agreed directly with us.

3. Our products

We take reasonable care to ensure that product descriptions, photographs, sizing information, prices and other information displayed on our website are accurate.

However:

  • colours may appear slightly different depending on your screen and device settings;
  • measurements and weights may be approximate;
  • natural fibres may have small variations in colour, texture and finish;
  • packaging may differ from images shown; and
  • we may make minor changes to a product where these do not materially affect its quality, performance or intended use.

Please review the relevant size guide and product care instructions before ordering and using a product.

4. Product availability

All products are subject to availability.

Adding a product to your basket does not reserve it. In rare circumstances, a product may become unavailable after you place your order.

Where we cannot supply a product, we will contact you and refund any amount you have paid for that product. We will not substitute a product without your agreement.

5. Prices and payment

Prices are shown in the currency selected on the website and include VAT or other applicable sales taxes where required.

Delivery charges, where applicable, will be displayed before you complete your order.

We may change our prices at any time, but a change will not affect an order that we have already accepted.

Payment must be made using one of the payment methods offered at checkout. Payment may be processed by a third-party payment provider.

Your card or payment method may be authorised when you place the order. This does not mean that we have accepted your order.

Pricing errors

We make reasonable efforts to ensure our prices are correct. If there is an obvious pricing or description error, we may cancel the affected order before dispatch.

Where this happens, we will contact you and provide the option to place a new order at the correct price. If we cancel the order, we will refund any payment already taken.

6. How an order becomes a contract

When you submit an order, you are making an offer to purchase the products in your basket.

After placing the order, you will receive an order acknowledgement. This confirms that we have received your order but does not mean that we have accepted it.

A legally binding contract is formed when we send you confirmation that your order has been dispatched.

Where products from one order are dispatched separately, each dispatch may form a separate contract for the products included in that dispatch.

We may decline or cancel an order before dispatch where, for example:

  • the product is unavailable;
  • payment cannot be authorised;
  • there is an obvious error in the price or product description;
  • we cannot deliver to the address provided;
  • purchase restrictions have been exceeded;
  • we reasonably suspect fraudulent or unauthorised activity; or
  • you have breached these terms.

If we cancel an order after taking payment, we will refund the relevant amount.

7. Delivery

Our available delivery services, charges and estimated timescales are set out in our Delivery Policy and at checkout.

We aim to dispatch orders within the timescale stated on our website. Delivery dates are estimates unless we expressly agree a fixed delivery date with you.

We may deliver an order in separate parcels.

You are responsible for providing a complete and accurate delivery address. Please contact us promptly if you notice an error. We may not be able to change the address after an order has been processed or dispatched.

Risk in the products passes to you when they are delivered to you or to a person nominated by you. Ownership passes to you once we have received payment in full.

If delivery is delayed because of an event outside our reasonable control, we will contact you and take reasonable steps to minimise the delay.

Unless a different timescale has been agreed, you may cancel the contract where we fail to deliver within 30 days or within an additional reasonable period that you give us.

8. International orders

International delivery options and charges will be shown at checkout where available.

Prices and checkout information will indicate whether applicable taxes and duties are included. For destinations where charges are not collected by us, you may be responsible for import duties, taxes or customs charges imposed by the destination country.

You are responsible for ensuring that products ordered from us can lawfully be imported into and used within the destination country.

Nothing in these terms removes any mandatory consumer rights that apply in the country where you live.

9. Your right to cancel

Where you are purchasing as a consumer, you normally have the right to cancel an online order without giving a reason.

The cancellation period begins when the contract is formed and ends 14 days after the day on which you, or a person nominated by you, receives the products.

Where an order is delivered in multiple parcels on different days, the cancellation period ends 14 days after the final parcel is received.

To exercise your right to cancel, you must clearly tell us that you wish to cancel. You can do this by contacting us by email or by using our withdrawal form.

You must then return the products within 14 days of telling us that you wish to cancel.

Your cancellation rights may not apply to personalised, customised or bespoke products, except where those products are faulty or not as described.

10. Returning unwanted products

You are responsible for the cost of returning unwanted products unless we have agreed otherwise or the products are faulty, damaged or incorrectly supplied.

While the products are in your possession, you must take reasonable care of them. You may inspect them in the same way that you reasonably could in a physical shop.

Products should be returned:

  • unused and unworn, other than as reasonably necessary to inspect them;
  • with tags still attached where possible;
  • clean and in a resalable condition; and
  • in their original packaging.

We may reduce your refund to reflect any loss in value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the products.

Please include your order number with your return.

11. Cancellation refunds

Where you cancel the whole order in accordance with your statutory cancellation rights, we will refund:

  • the price paid for the returned products; and
  • the cost of our least expensive standard delivery service offered when the order was placed.

Any additional amount paid for express, premium or enhanced delivery will not normally be refunded.

We will issue the refund within 14 days after we receive the returned products or, if earlier, within 14 days after you provide acceptable evidence that they have been sent back.

Refunds will only be made using the original payment method. Your bank or payment provider may take additional time to display the refund.

12. Faulty, damaged or incorrectly supplied products

Products must be of satisfactory quality, fit for their intended purpose and as described.

Please contact us promptly if you believe a product is faulty, damaged or different from what you ordered. We may ask you to provide photographs, order information or other reasonable evidence so that we can assess the issue.

Depending on the circumstances and your legal rights, you may be entitled to a repair, replacement, price reduction or refund.

Where a product is confirmed to be faulty or incorrectly supplied, we will cover reasonable return costs.

Any Moggans product warranty is provided in addition to your statutory consumer rights and does not replace or restrict those rights.

13. Promotions, discount codes and special offers

Promotions and discount codes may be subject to additional conditions displayed with the relevant offer.

Unless we expressly state otherwise:

  • promotions apply only to eligible products;
  • promotions are available for a limited period and while stocks last;
  • promotions and discount codes cannot be used in conjunction with another promotion, offer or discount;
  • only one discount code may be used per order;
  • discount codes have no cash value;
  • discounts cannot be applied retrospectively to an order already placed;
  • we may limit the number of promotional products available to each customer; and
  • we may withdraw or amend a promotion before an order is placed.

For a “buy three, pay for two” or similar offer involving differently priced eligible products, the cheapest eligible product will normally be provided free unless the promotion states otherwise.

Where you return part of a promotional bundle, your refund may be recalculated to reflect the products you keep and the discount originally applied. You will never be refunded more than the amount you paid.

We may cancel an order where we reasonably believe a promotion or discount has been misused, including through multiple accounts, automated purchasing or fraudulent activity.

14. Gift cards

Where gift cards are available, they may be subject to additional terms displayed at the time of purchase.

Gift cards cannot be exchanged for cash, except where required by law. Lost, stolen or unauthorised gift cards may not be replaced unless we are responsible for the loss.

15. Using our website

You may use our website only for lawful purposes.

You must not:

  • misuse or interfere with the website or its security;
  • introduce viruses, malicious software or harmful code;
  • attempt to gain unauthorised access to the website, server or connected systems;
  • use automated systems to scrape, copy or purchase products without permission;
  • submit false, misleading or fraudulent information;
  • impersonate another person;
  • infringe our intellectual property or the rights of another person; or
  • use the website for unlawful or unauthorised commercial activity.

We may suspend or restrict access where we reasonably believe these terms have been breached.

16. Customer accounts

Where you create an account, you are responsible for keeping your login details secure and for activity carried out through your account.

Please contact us promptly if you believe your account has been accessed without your permission.

We may suspend or close an account where we reasonably suspect fraud, misuse or a serious breach of these terms.

17. Intellectual property

The website and its content—including the Moggans name, logos, product designs, photographs, illustrations, graphics, videos, written content and software—are owned by or licensed to us and are protected by intellectual-property laws.

You may view and use the website for your personal, non-commercial use.

You must not copy, reproduce, modify, publish, distribute, sell, licence or commercially exploit any part of the website or its content without our prior written permission.

18. Reviews and other customer content

Where you submit a review, photograph, comment or other content, you confirm that:

  • the content is based on your genuine experience;
  • it is accurate to the best of your knowledge;
  • you have the right to submit it;
  • it does not infringe another person’s rights;
  • it is not unlawful, abusive, discriminatory or defamatory; and
  • it does not contain confidential information or malicious code.

You grant us a non-exclusive, worldwide and royalty-free licence to use, reproduce and display the submitted content in connection with Moggans and our marketing, subject to applicable law and our Privacy Policy.

We may remove content that breaches these standards.

19. Third-party services and links

Our website may include links to websites, payment services, review platforms or other services operated by third parties.

These services are not controlled by us, and their own terms and privacy policies may apply. A link does not necessarily mean that we endorse the third-party service or its content.

20. Our responsibility to you

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

Loss or damage is foreseeable where it is obvious that it may happen or where, when the contract was made, both you and we knew that it might happen.

We do not exclude or limit our responsibility where doing so would be unlawful, including responsibility for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • defective products where liability cannot legally be excluded;
  • breach of your statutory consumer rights; or
  • any other liability that cannot legally be excluded or restricted.

We supply products for private and domestic use. If you use a product for an unauthorised commercial, business or resale purpose, we will not be responsible for loss of profit, loss of business, business interruption or loss of business opportunity.

Nothing in these terms affects your statutory rights.

21. Events outside our control

We will not be responsible for a delay or failure caused by circumstances outside our reasonable control.

These may include severe weather, transport disruption, industrial action, fire, flood, epidemic, pandemic, acts of government, customs delays, failures of telecommunications or payment systems, and interruptions affecting suppliers or delivery partners.

Where such an event materially affects your order, we will contact you and take reasonable steps to minimise its impact. Where there is a substantial delay, you may have the right to cancel and receive a refund for products not supplied.

22. How we use personal information

We process personal information in accordance with our Privacy Policy.

Please review that policy for information about the personal data we collect, why we use it, who we share it with and your rights.

23. Changes to these terms

We may update these terms from time to time, including to reflect changes to our products, website, business practices or legal obligations.

The terms in force when you place an order will normally apply to that order.

The date at the top of this page shows when the terms were last updated.

24. Transfer of rights

We may transfer our rights and obligations under these terms to another organisation, for example as part of a sale, reorganisation or transfer of our business.

We will ensure that any transfer does not reduce your rights under the contract.

You may transfer your rights under these terms only with our written agreement, except where the law allows otherwise.

25. If part of these terms is invalid

Each section of these terms operates separately.

If a court or other competent authority finds that any section is unlawful or unenforceable, the remaining sections will continue to apply.

26. Delayed enforcement

If we do not immediately enforce a right under these terms, this does not mean that we have waived that right.

27. Third-party rights

The contract is between you and us. No other person has the right to enforce its terms, except where the law expressly provides otherwise.

28. Governing law and disputes

These terms and any contract between you and us are governed by the laws of Scotland.

Nothing in this section deprives you of mandatory consumer protections provided by the laws of the country in which you live.

You may bring legal proceedings in the Scottish courts. If you live elsewhere in the United Kingdom or another country, you may also be entitled to bring proceedings in the courts where you live.

We encourage you to contact us first so that we can try to resolve any concern directly.
